BOARD OF SUPERVISORS

MEETING OF JULY 12, 2010

 

The regularly scheduled meeting of the Potter Township Board of Supervisors was held on Monday, July 12, 2010 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Ron Sweitzer Vice Chairman, Dick Decker and Jake Tanis, III attending.  Also attending were Solicitor Robert Rayman & Road Superintendent (and Acting Secretary) Budd Brooks.  Absent were Tom Sharer, Bob Corman and Brenda Burd.

                                                

Also in attendance were Binky Lush, Kathy Mothersbaugh, Mary Ellen Whalen, Fred Henry, Dennis Heggenstaller, John R. Zerby, Mick Rowles, Gayle Kuhlman, Bruce & Brenda Homan, Sandra Rishel, Ronald Kuhlman, Joy & Alan Decker and Chad Stafford.

 

At 7:00 P.M. Vice Chairman Sweitzer opened the meeting with the pledge to the flag. 

 

Citizen’s Concerns

·         Mrs. Whalen complimented the road crew for the nice job they did.

·         M. Rowles thanked the road crew for putting the signs up at Boal Gap Road.

·         M. Rowles expressed negative concerns regarding the sewage management program.

·         J. Zerby expressed negative concerns regarding the sewage management program.

·         G. Kuhlman asked that the 537 Plan be explained. Chuck Herr explained the 537 Plan is the PA Sewage Facilities Act (SFA) enabled by the Federal Clean Streams law.  The SFA covers things from factory discharge through on-lot septic systems (but not Ag).  All municipalities are bound under the SFA to have their own 537 Plan designating areas in the Township served by on-lot sewage or municipal sewer.  Chapter 72, Title 25 of PA Code states each Municipality must have a current plan for sewage disposal for greater than 20 years.  A method to prove compliance with this is on-lot sewage programs.  What Potter wanted was 5 yr. pumping & 10 yr. program, but DEP said it will be a 3 yr. pumping & 6 yr. program and DEP set the Township fines for non-compliance at the state level of $2,500 to $5,000 per day per event; so the state mandated what our municipal ordinance says.  DEP told us we would be reimbursed 50% of the inspections but since then, money has dried up so Chuck’s fees are charged to the property owners.  Within 6 years we must inspect everyone with a septic system at some level of inspection.  Chuck is meeting with DEP to try to find a solution for Potters Mills as a whole since the lots are small and the groundwater is high.  Chuck also said he’s not shut anyone down nor does he plan to shut anyone down; solutions will be found instead. 

·         Bruce H. asked what the sewage management plan means to him. Mr. Sweitzer said the Board is trying to come up with a solution that’s cost effective for everyone in Potters Mills; to accommodate all the problems.

·         Bruce H. said minutes published on-line are not sufficient to inform the people what is said at meetings.  Mr. Decker said only certain information is required in minutes which Mr. Rayman confirmed. 

 

Approval of the minutes

·         Minutes of June 14, 2010 were approved as presented by motion of Mr. Tanis, seconded by Mr. Decker, carried unanimously 3-0.

·         Treasurer’s Report of June 30, 2010 was approved as presented by motion of Mr. Tanis, seconded by Mr. Decker, carried unanimously 3-0.   

 

Roy Rupert monthly CCP report (no report)

 

CCP – by Dennis Heggenstaller, Nittany Engineering (Country Club Park)

·         Dennis presented bills totaling $178,793.57 with $118,842.94 from H2O grant and $59,950.63 from Jersey Shore Bank loan.  Mr. Tanis made the motion to approve these payments, seconded by Mr. Decker, carried unanimously 3-0.

·         The pump station will not be shipped until July 19th

(CCP Report continued)

·         Initial start up of the plant was July 12th.  Official start up will be July 13th.

·         The PennDOT Highway Occupancy Permit expired & we applied for an extension.

 

Subdivisions

·         Galen Dreibelbis asked what EDUs are availabile for the next Country Club Park Phase.  The Township first needs to get a firm number from Eric Lundy.  Ron will call Eric.

·         Fred Henry presented plans for Colyer Lake Properties, LP.  Do they need a road name for the lot?  Yes.  The road name Stairs Lane was presented and approved on a motion by Mr. Decker, seconded by Mr. Tanis, carried unanimously 3-0.  Do they need a Stop sign – yes.  Mr. Tanis made a motion to place in-lieu-of fee verbiage on the plan and that there is to be no more than 1 dwelling constructed on that driveway, seconded by Mr. Decker, carried unanimously 3-0.

 

Planning Commission – Dick Decker

·         Working on Grange Fair display.

·         Planning Commission reviewed the proposal/contract to update & codify all Ordinances and recommend approval.  Mr. Decker made that motion, seconded by Mr. Tanis, carried unanimously 3-0.

·         Reviewed 2-Conditional Use applications & have comments.

 

Mr. Sweitzer presented a Traffic Impact Study for the proposed Sheetz at SR 144/45.  Mr. Decker made the motion to approve the study, seconded by Mr. Tanis, carried unanimously 3-0. 

 

Solicitor’s Report – Bob Rayman

·         Reported Bill Pyle cannot be Tax Collector and serve on the Zoning Hearing Board and the Supervisors need to ask him to resign from the Zoning Hearing Board.

·         If G. Dreibelbis wants to reserve excess capacity for CCP, we need to get a deposit from him. (To be determined after a firm number is established)

·         Advised Binky Lush since all their work is done, she can get the original Letter of Credit from Brenda & return it to the Bank.

·         There are 2-Conditional Use applications already reviewed by the Planning Commission. The Board set Wed., August 4th Earl Yearick at 6:30 PM and Sheetz at 7:00 PM.  Budd was asked to do legal ads for the paper.

 

Secretary/Treasurer’s Report – Budd Brooks

·         Budd presented 2-Highway Occupancy Permit applications from Jeff along SR 144 near the Keith Luse property – both have sight distance.  The Board wants to see the subdivision plans first.

·         Roy Rupert did the Consumer Confidence Report for which he waived his fee this year & Brenda mailed to CCP residents on 6/18/2010.

·         Regarding Tractor Rally in the Valley, the waiver was approved by Bob R. but no insurance certificate was received yet.

·         Presented bills to be paid list for review & approval.  All bills approved by all 3-Board members.

·         No dates received yet from Mike Clitherow to meet with the Board.

All correspondence was copied to the Board.  

 

Road Superintendent’s Report – Budd Brooks

·         Got a $14,000 Dirt & Gravel Grant for Egg Hill Road improvements.

·         Paving is done.

·         The one oiling & chipping job is done; the other one will be done 7/13.

 

Penns Valley Regional Planning Commission – no meeting

 

 

Tri-Municipal Park – Dick Decker

They drafted a lease agreement but he doesn’t know the status.

 

 

Old Business

·         Operator for CCP – Ruperts are continuing their services and will train on new equipment.

·         Web Site maintenance – waiting for dates to meet with Mike Clitherow.  Binky Lush volunteered her services.

 

New Business

·         Discussed the letter from Centre County Solid Waste requesting a donation for promoting recycling.  Decided no donation.
