BOARD OF SUPERVISORS

MEETING OF MAY 10, 2010

The regularly scheduled meeting of the Potter Township Board of Supervisors was held on Monday, May 10, 2010 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Tom Sharer Chaiman, Ron Sweitzer Vice Chairman, Bob Corman, Dick Decker and Jake Tanis, III attending.  Also attending were Solicitor Robert Rayman, Road Superintendent Budd Brooks, and Secretary/Treas. Brenda Burd.

                                                

Also in attendance were Eric Lundy, Sandra Rishel, Dave Kronenwetter, Ann Glaser and Binky Lush.

 

At 7:00 P.M. Chairman Sharer opened the meeting with the pledge to the flag.

 

Citizen’s Concerns – none

 

Approval of the minutes

·         Minutes of May 3, 2010 were approved as presented by motion of Mr. Tanis, seconded by Mr. Sweitzer, carried unanimously.

·         Treasurer’s Report of April 30, 2010 was approved as presented by motion of Mr. Corman, seconded by Mr. Sweitzer, carried unanimously.   

 

CCP – by Eric Lundy, Nittany Engineering  (Country Club Park)

·         4-M Construction’s pay Application #4 for $438,379.25 was not paid because of safety concerns.  Mr. Decker made a motion to pay Application #4, seconded by Mr. Sweitzer, carried unanimously.

·         The electrical panel was not correct but has been made correct.

·         Presented Application #5 for 4-M Construction for $85,125.38; and

·         Application #1 for Dave Kronenwetter for $39,398.13; and

·         Application #1 for Harger Construction for $33,795.00; and

·         Engineering bills for $10,189.32; totaling $168,507.83 of which $111,848.15 will come from H2O grant and $56,659.68 from Jersey Shore Bank.  Mr. Corman made the motion to approve these bills, seconded by Mr. Decker, carried unanimously.

·         A construction progress meeting will be 5/17/2010 at 10:00 am at the job site.

 

Opening of 2010 Paving Bids

               $123,201.30                             $123,228.00                        $127,903.50         $167,254.50

All Bids have Bid Security that appear to be okay.  Mr. Sweitzer made a motion to accept Hawbaker’s Bid contingent on Budd’s review, seconded by Mr. Tanis, carried unanimously. 

 

Binky Lush gave an update of construction & events. She was told to get their permit as soon as possible.  An executive session was established with Lush’s for June 14, 2010 at 6:00 pm on a legal issue.

 

Subdivisions – none

 

Planning Commission – no meeting

 

Solicitor’s Report – Bob Rayman

·         Advised we have Lush’s Letter of Credit which can be released once the sand mound is completely done.

·         There had been some sewage issues at some camps – one has been resolved & one is almost resolved.

·         The new developer at CCP contacted him about the roads issue.  He told him they should contact Budd for confirmation of roads standards.

·         He developed guidelines for bikers using our roads for events – the Board adopted the guidelines.

 

(Solicitor’s Report continued)

·         He worked with Norm Lathbury on the Ag Security Resolution – which the Board adopted.

·         He received a notice from Commonwealth Court on a tax case for State College Baseball Club.  He will need to attend the mediation and write a statement – he’ll keep the Board posted.

·         Presented Grant of Easement; License Agreement; and Sewer Capacity Purchase Agreement with UHS (Meadows).  Mr. Sweitzer made the motion to sign these agreements, seconded by Mr. Decker, carried unanimously – signed all 3.  The Grant of Easement and License Agreement need recorded.

 

Secretary/Treasurer’s Report – Brenda Burd

·         Presented bills to be paid list for review & approval.  All bills approved by all Board members.

·         Reported Lush’s Letter of Credit was received 5/7/10 via Federal Express to which I immediately advised Jeff, Tom & Mr. Rayman’s office.

·         Discussed my vacation – I will email the Board when I take days off with little notice.

·         Reported the next County Secretary’s meeting is Wed. 5/26 at 11:30 am.

·         Reported I responded to Anson Burwell’s letters regarding Spigelmyer’s Planning Module & Municipal Response request.

·         Reported I had several follow-up calls from Joe Rocco of Comcast about our call forwarding problem.

·         The mail box outside Jeff’s office is a problem. They decided Budd & Jeff should talk with the mail carrier but suggested it be placed at the Tucker Rd end of building # 1.

All correspondence was copied to the Board.  

 

Road Superintendent’s Report – Budd Brooks

·         Gave written report on riff raff.

·         Got the drainage ditch filled on Middle Road

·         Has the signs for placement at Pole Cat Rd./High St. intersection

·         Started mowing around the Township

·         They will work on getting the paving project ready now that bids are opened

 

Penns Valley Regional Planning Commission – no meeting

 

Tri-Municipal Park – no meeting

 

Old Business

·         Brenda was asked to confirm one person’s attendance at the CCATO convention with the CCATO Secretary.

·         Tom received a letter from Stephen Gover, PennDOT that Wheatfield, along SR 322 is not an issue. 

·         Brenda was instructed call Ruth Rishel on how the round barn books money will be handled.
