BOARD OF SUPERVISORS

MEETING OF JUNE 8, 2009

 

The second regularly scheduled meeting of the Potter Township Board of Supervisors was held on Monday, June 8, 2009 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Tom Sharer, Jake Tanis, III, Bob Corman and Dick Decker attending.  Also attending was Road Superintendent Budd Brooks, Solicitor Robert Rayman and Secretary/Treas. Brenda Burd.  Ron Sweitzer was absent.

 

Also in attendance were Eric Lundy, David Tshudy, Esq., Robert Miller, Mary Ellen Whalen, Mel Sammis, Sandra Rishel and Martin & Judy Melville.

 

At 7:00 P.M. Chairman Sharer asked everyone to stand and pledge allegiance to the flag after which he called the meeting to order. 

 

Approval of the minutes

·         Minutes of June 1, 2009 were approved as presented on a motion by Dick, seconded by Bob, carried unanimously.

·         Treasurer’s Report of May 31, 2009 was approved as presented on a motion by Bob, seconded by Dick, carried unanimously.   

 

Citizen’s Concerns

·         Mel asked when a decision would be made on the proposed sewer ordinance.  Bob R. clarified that the public hearing was for public comment, and vote will take place July 6, 2009.

 

Eric Lundy, Nittany Engineering (NEA) for CCP

·         Eric commented on the open records request from Mr. Seed which Bob R. asked Eric for his comments on a draft tapping fee and connect ordinance. 

·         Bob R. explained that current CCP homes can’t be charged a tapping fee because they already exist on the system, but the Meadows will need to pay tapping fee(s) since they are not on the system.

·         Eric reported they will proceed to meet executive order deadlines.  They are proceeding with design and force main work; the GeoTech work will go to potential bidders and he & Bob Miller will meet about a bore hole on Meadows property.

·         PennVest meets July 21st for grant application review. 

·         H2O Grant application will be reviewed July 14th.

                                        

Rob Fye, Centre County Solid Waste Authority Enforcement Officer

Rob gave a presentation on his and the County Waste Authority’s jobs, and discussed Municipal responsibility toward the same end.  Municipalities can enact ordinances, hold riff raff days, hire haulers to ensure garbage is picked up and cause less wear & tare on the roads.  Handed out proposed ordinances for the Board to consider.

 

Solicitor’s Report – Bob R.

·         A Right-Of-Way Agreement will be coming for the Montminy minor subdivision adding 1-more lot.

·         Asked status of Park & Ride Agreement. Greg Kausch has & FHWA is still reviewing. We need to be sure we get the correct version when it comes back for signature.

·         Asked if Chuck Herr should attend the 7/6 meeting when deciding on the Sewage Ordinance. (said they’d talk about it) The Public hearing is done, discussion should be done and you should just vote on it.

·         Reported he’s working with Jeff on a legal issue. Two citations will be issued: 1 from Jeff for zoning and 1 from Chuck for sewage.

·         Budd confirmed the snowmobile crossing letter to PennDOT is okay.  Yes.

 

Planning Commission Report – Dick

·         They are reviewing a draft small wind ordinance.

·         A few Commission members signed up for a geothermal systems conference at Rock Springs.

·         Reported they do have a table at Grange Fair again.

·         Tom reported a meeting 6/11 at the Township with Mike Bloom of the County office to present a growth forecast for Potter Township.  Tom, Jeff and Lynda Powell will attend.

 

Subdivisions – none

 

Secretary/Treasurer’s Report – Brenda

·         Presented bills to be paid list through June 8, 2009 for review and approval.  All bills approved by all four Board members present.

·         Presented Pension Plan update completed by Dave Whiteman and reviewed by Rick Bair.  Dick made a motion for Bob Corman, Trustee, to sign, seconded by Jake carried unanimously. 

·         Asked who they want to be the Trustee to replace Monty Strouse on the plan – Dick made a motion for Jake Tanis to be Trustee, seconded by Bob, carried unanimously.

·         I handed out updated Fire Tax accounting update tonight (6/8)

·         I handed out an email from Mary Carol Frier who’s interested in volunteering.  I will file.

·         We received an announcement from Rep. Benninghoff on a heavy equipment auction which I copied to Budd.

·         Reported a dotGrants work shop sponsored by PennDOT Tues., June 16th which I committed to attend.

·         Reported the Township is invited to a “full depth reclamation” work shop Wed. June 10th at Ferguson Twp. sponsored by PennDOT.

·         Reported we received notice from Karen Weiss, NEA that DCED needed a letter on our letterhead for the H2O Grant application that Potter Township owns & operates the sewage collection system & treatment plant & the proposed project and that we will own, operate & maintain the system after project upgrade; and Tom signed that letter June 3rd.

·         Reported I received a large open records request Mon., 6/1 which I asked Karen Weiss, NEA for her assistance with records and the files were mailed to the requester 6/5.

·         A correspondence I forgot on the correspondence list is 5/29/09 Stormwater Management Report for Park & Ride from PennDOT which they also mailed to Don Franson for his review.

Correspondence as listed separately and distributed. (no questions)

 

Tom said I should follow up with Mike on setting up the Right-to-Know information on the web site.

 

Road Superintendent’s Report - Budd

·         Presented the indemnification letter to PennDOT on the snowmobile crossing signs for signatures.  Bob made a motion to sign, seconded by Jake, carried unanimously.

·         Presented the County Liquid Fuels application for Weaver Road for signatures.  Jake made a motion to sign, seconded by Dick, carried unanimously.

·         Reported he heard back from PennDOT on the request at Williams Road.  They will install ‘left turn’ signs and ‘do not pass’ signs.

·         Asked about rebuilding a section of Indian Lane.  They discussed and told him to proceed.

 

Country Club Park – none

 

Penns Valley Regional Planning – minutes handed out  

 

Bob commented on the high cost of advertising for riff raff & brush collection on the bills list and suggested alternative advertising, like Valley Vine, on farm wagons, the Newsletter only.

 

Old Business – none

 

New Business

·         Jake commented on the dead elm trees on the land we own.  It was suggested a forester do a management plan and then follow up on it.

·         Jake reported it looks like the school district will increase taxes.

 

Bob asked about the cost of the Tel-Power bill to replace the one damaged by wind at Rtes. 322/144.  It was turned in to our Insurance Company.    

 

Open Discussion

·         Tom asked about internet banking – nothing yet.

·         Tom asked Budd if he’s ok with a reduced crew.  Yes.

·         Budd was asked if he hired a part-time mower yet.  He didn’t start yet.

 

At 8:15 PM Chairman Sharer recessed the regular meeting and called an executive session on personnel.

 

At 8:30 PM Chairman Sharer closed the executive session and reconvened the regular meeting.

Bob made a motion, seconded by Dick to adjourn, meeting adjourned at 8:30 PM.
