BOARD OF SUPERVISORS

MEETING OF JANUARY 8, 2007

 

The second monthly meeting of the Potter Township Board of Supervisors was held on Monday,

January 8, 2007 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Tom Sharer, Bob Corman, Richard Poorman, Monty Strouse and Paul Zerby present.  Also attending were Secretary Brenda Burd and Road Superintendent Budd Brooks. 

 

Also in attendance were John Thompson, Stan Wallace, Frank Cummins, Mary Ramsey, Harry Burd, John Zerby, Scott Floray, Dennis Foust, Amy Grove, Sandra Rishel, Ann Glaser, Charles Musser, Mary Stevens, Beth Whiteman, Alan Decker, Dick Decker, Penny Waltz, Mary Ellen Whalen, and Brandi and Seth Marks.

 

At 7:02 P.M. Chairman Sharer opened the meeting by asking everyone to stand and pledge allegiance to the flag after which he called the meeting to order. 

 

Additions and corrections to minutes/financials

·         Minutes of December 11, 2006 were approved on a motion by Bob C., seconded by Paul, motion carried.

·         Minutes of January 2, 2007 were approved on a motion by Bob C., seconded by Monty, motion carried.

·         Financial Report for December 2006 was not yet prepared.

 

Planning Commission Report

·         Monty reported they reorganized; Rod is Chair and Lucy is their new Secretary.

 

Subdivisions

·         John Thompson, Uhler Assoc., for Agnes Homan – presented a mail-in Planning Exemption for a proposed 4-lot subdivision.  Paul made a motion for Brenda to sign out of meeting on the condition Dave Hartnett signs letter of commitment accepting the sewage for the four-lots, seconded by Rich, motion carried.

·         Stan Wallace, Nittany Engineering, for Sinking Creek Subdivsion   discussed a proposal letter to the Board to lower the speed limit on S.R. 144 at the intersection of Sinking Creek Road from 55 mph to 45 mph and to make improvements to the intersection to eliminate the need of a turning lane.  Stan suggested presenting all data to PennDOT for them to decide.  Paul made a motion to support Stan’s proposal to request lowering the speed limit by PennDOT.  Motion died for lack of support.

  • Memorandums were mailed to the Board

 

Secretary’s Report

·         Presented bills to be paid for review and approval.  All were approved.

·         Presented MS-965 Form for Liquid Fuels Actual Use in 4-originals for 3-signatures.  Bob C. made a motion to sign the MS-965 Form, seconded by Rich, motion carried and forms signed.

·         Presented Municipal Response Request for Lot 9 Replot of Hidden Lake Estates for Dr. O.  Monty said what the Planning Commission reviewed was a conditional use and it cannot be classed as commercial.  Comments for the form are ‘the correspondence says commercial and it’s not commercial and lot 9A as commercial-medical is non-conforming, it’s not commercial-medical, it’s a conditional use’.  Bob C. supported that as a motion and added that a driveway permit is needed where the lots come out onto the Township road, seconded by Rich, motion carried and form was signed.  After discussion, it was determined it is commercial.

·         Presented 3-CDs, #1546, 1554, and 1562 that do not automatically renew and asked for signatures so action can be taken immediately upon their maturing 1-29-07.  After discussion, Bob C. made a motion to open three 6-month CDs, seconded by Monty, motion carried.  CD’s signed.

·         Asked authorization to pay for Planning Commission members to attend PSATS convention.  I was told it’s budgeted so it’s okay.

·         Asked permission to attend a work shop in State College March 13th.  Yes.

·         Asked how I should handle people requesting zoning refunds.  Hold until a zoning officer is hired.

Road Superintendent’s Report

·         They are upgrading the guiderail and doing bridge maintenance

·         We will open stone and oil bids February 12th

·         Received a letter from Don Franson on expansion to the office

 

Country Club Park

·         The filter is on-line at the new WWTP

·         Reported there is a small water leak he needs to locate

 

Bob C. asked about paving bids.  Not until March.

 

Penns Valley Regional Planning Commission Report

·         Tom said they meet Mon., January 15, 2007 to reorganize and will meet the 3rd Monday of every other month at Gregg Township.

 

New Business

·          Spring Creek Watershed – Bob Rayman’s comments were received.  Bob C. made a motion to support the inter-municipal agreement, seconded by Monty, motion carried.  Brenda should advertise public hearing for February 12th.

·          A voting delegate for the Township at PSATS was discussed.  Tom will be our voting delegate.

·          On zoning, they will hold an executive session.

 

Open Discussion and Citizen’s Concerns

·         Seth and Brandi Marks commented on their sewage problem and Chuck Herr.  Tom advised the Marks to get written documentation from DEP.

·         Harry Burd asked about set backs.  The Planning Commission will consider his concerns with their zoning review.

·         Chuck Musser commented on an issue he has on his private road.  Tom said the Zoning Officer will need to handle this.

 

At 8:45 P.M. Tom called executive session on personnel.

 

Adjourn

·         At 9:25 P.M. the executive session was closed, the regular meeting reconvened and adjourned.
