POTTER TOWNSHIP
BOARD OF SUPERVISORS
MEETING OF AUGUST 8, 2005
The monthly meeting of the
Potter Township Board of Supervisors was held on Monday, August 8, 2005 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Paul Zerby, Monty
Strouse, Bob Corman and Richard Poorman present. Also attending were Road Superintendent Budd Brooks, Solicitor Robert Rayman and Zoning Officer Jeff
McClellan. Tom Sharer and Brenda Burd
were absent.
Also attending were Mike
Clitherow, Sandra Rishel, Ann Glaser and Alan Decker.
Chairman Zerby called the
meeting to order at 7:00 P.M.
Minutes of the August 1, 2005 meeting and the Financial Report were approved with
the following corrections and comments: Bob
C. asked if Budd actually requested a resolution under the Road
Superintendent’s Report; Budd said yes. Bob C. said the second item under the Road
Superintendent’s Report should read “Suggested electrical changes be made to
allow for a generator to be hooked up at the Old Fort traffic light in the
event of a power outage”. Bob C. said the
last sentence before recessing to the worksession reads: “If it is a building
violation and Jeff is aware of it, Jeff should report it to Rick”. Bob said the issue he raised was: “Is Jeff
the policeman? Is Jeff supposed to be
going out and policing violations for Rick?” Jeff is not the code enforcement officer he is
the zoning enforcement officer. With
these corrections and comments, Bob C. made a motion to approve, seconded by
Rich; motion carried unanimously.
Citizens Concerns – none.
Planning Commission Report
- Monty reported they reviewed correspondence from
the County; mostly plan extensions.
Zoning Officer’s Report

Presented reports
for May, June and July.

Next month he
will have the year end report for the Supervisors.
·
Asked if he is
supposed to be Policeman for Keystone Inspection. Discussion followed and Paul advised Jeff to
talk to Rick.

Old Business
– none.
Solicitor’s Report
·
He advised the
Board that a referendum can be placed on the ballot 60-days prior to the
election. Paul made a motion to put the
referendum on the ballot for purchasing the Penn State land, seconded by Bob C. Motion carried unanimously.

He asked about the
Township Manager proposal. Paul said
that Budd has been doing the Township Manager work and if they do hire a
Manager it would be nice to have Budd move up to that position. Ann Glaser asked an average salary for
Manager and how do you know when ready to hire a manger. Discussion followed. Bob R. recommends the Township hire a Manager
now. The Board decided they are not
ready to hire a Township Manager at this time.

He asked if Budd
heard from the County on our grant request for Country Club Park. We haven’t.
Budd was advised to follow up on it.

Presented the
Memorandum of Understanding (MOU) for SEO charges. Bob C. made a motion to adopt the MOU,
seconded by Rich; motion carried unanimously.

Road Superintendent’s Report
- Reported the Ashford Manor roads were inspected
today (8/8/05) and they will be offering the roads for dedication. He said a document needs drawn up to
protect the roads. He was told it
should have been part of the development plan to take it over; but Budd
said although it had been discussed, it had not been done. They discussed bonding and a letter of
credit. They agreed that Ashford
Manor needs to put something up front to protect the Township. Bob R. will talk to Ashford Manor’s
attorney.
- Kevin Kline of PennDOT will meet with
2-Supervisors and Budd on Tuesday, August 16, 2005.
- Read aloud the letters received to date for the
Sinking Creek Subdivision from 1. Carol and Susan Walker, 2. Frank and Irene
Cummins, 3. Doris and Tom Smeltzer, and 4. Todd and Betsy Hockenberry. These letters should be made available
to the Township Planning Commission.

At 7:50 P.M. Chairman Zerby recessed the regular meeting for an
executive session on a legal issue.
At 8:05 P.M. Chairman Zerby closed the executive session and
reconvened the regular meeting.
