BOARD OF SUPERVISORS

MEETING OF JUNE 13, 2005

 

The second monthly meeting of the Potter Township Board of Supervisors was held on Monday,

June 13, 2005 at 7:00 P.M. at the Township Building, 124 Short Road, Spring Mills, PA with Supervisors Paul Zerby, Monty Strouse, Bob Corman, Richard Poorman and Tom Sharer present.  Also attending were Road Superintendent Budd Brooks, Solicitor Robert Rayman and Secretary Brenda Burd. 

 

Also attending were Stan Wallace, Ron Seybert, John Miknis, Sandra Rishel, Ann Glaser, Dave Henning, Mike Clitherow, and Carl Bankert.

 

Chairman Zerby called the meeting to order at 7:00 P.M.

 

Minutes of the June 6, 2005 meeting and the Financial Report were approved on a motion by Rich with the following correction:  Under Secretary’s Report, the last sentence should read ‘Paul abstained’, seconded by Bob C., motion carried unanimously.

 

Citizens Concerns – none.

 

Planning Commission Report

  • Monty reported they reviewed Penn Terra’s response to the Planning Commission’s concerns on Mt. View Estates.
  • They reviewed and signed a Planning Module for Monte and Jack Whitehill. 

 

Subdivision

·         Monte and Jack Whitehill – Stanley Wallace presented a Planning Module for a Small Flow Treatment Facility.  Tom made a motion to approve the Planning Module, seconded by Rich, motion carried unanimously.  As part of the Planning Module, Resolution #7-2005 was presented.  Paul made a motion to approve Resolution #7-2005, seconded by Tom, motion carried unanimously.  Both the Planning Module and Resolution were signed.

·         Mt. View Estates – John Miknis said they have addressed the Planning Commission’s letter of concerns except two items.  Item one is Stormwater Management (SWM).  The County’s Ordinance does not require detailed SWM until the final plan, but the Township requires detailed SWM under the preliminary plan.  He requests a waiver under the Township Ordinance stating the calculations cannot be done at this time.  Monty said a big concern is with the residents that live next to the retention pond.  The Planning Commission was told the final plan still needs to be submitted with detailed SWM and the Township Engineer still has to review and approve the plan.  Tom made a motion to approve a waiver on SWM for this preliminary plan.  After discussion, Monty seconded the motion ‘with reservations’.  Monty stated the end product must be what is required.  He said our engineer must be involved with the Planning Commission when the final plans come in; #1 to help put the Planning Commission at ease with this waiver and #2 to make sure nothing gets overlooked.  Paul stated this waiver is taking authority away from the Planning Commission and going over their heads.  Paul called for a vote and the motion carried with four ayes and Paul opposing.

·         Mt. View Estates – The second issue is the traffic study and John presented Ron Seybert of Trans Associates who performed the study.  Ron stated 70% of the enter/exit development traffic would be Boalsburg traffic and 30% would be Old Fort.  Both directions require a turning lane on Route 45 with 1-lane in and 1-lane out.  Neither direction requires a traffic signal at Route 45.  Bob C. said a big concern is with growth down the valley, on both Routes 45 and 192. 

·         Mt. View Estates – Tom asked John about Item #10 of Penn Terra’s response letter to the Planning Commission which states the roof sumps are deleted.  John said that will be corrected.  John said they put sumps in, but sized ponds as though sumps were not there.

Solicitor’s Report

·         He checked the Amusement Tax Ordinance and it does include athletic events.  It is the Secretary’s responsibility to put the State College Baseball Club on notice that they are subject to the tax, send them a copy of the Ordinance and ask the ball club to start providing the Township with their receipts and the tax.

·         The Earned Income Tax Collector received some W-2s showing local tax withheld but she has never received the tax from the employer.  Because it’s not a local jurisdiction he suggested she contact the PA State Police to file criminal charges.  This was okay with the Board.

·         On Country Club Park, John Miller told him the Sewer Authority will sign the Cooperative Agreement at their next meeting (June 21).

·         Someone asked him about submitting a proposal to the Board to be Township Manager.  The Board said they can look at the proposal.

Road Superintendent’s Report

  • Reported they are scheduled to pave the end of this week (June 17).
  • Received verbal notice our Dirt & Gravel Grant was approved.
  • Presented CCP Chapter 94 Report for the Chairman’s signature. 

 

Penns Valley Regional Planning Commission

·         Tom said it is important to review the “Future Planning” chapter and the Regional maps; and try to attend the June 27 meeting.

·         It was suggested the Planning Commission and Supervisors meet jointly to discuss the new comprehensive plan but no date was chosen.
