BOARD OF SUPERVISORS

MEETING OF JUNE 7, 2004

                                                                                        

The first monthly meeting of the Potter Township Board of Supervisors was held on Monday, June 7, 2004 in Township Building #2, 124 Short Road, Spring Mills, PA with Supervisors Paul Zerby, Monty Strouse, Bob Corman, Rich Poorman and Tom Sharer present.  Also attending were Road Superintendent Budd Brooks, Zoning Officer Jeff McClellan, Solicitor Robert Rayman, and Secretary Brenda Burd.

 

Chairman Zerby called the meeting to order at 7:00 P.M.

 

Minutes of the May 10, 2004 meeting were approved as presented on a motion by Bob C. and seconded by Rich.  Motion carried unanimously.  

 

Citizens Concerns – none.

 

At 7:01 P.M. Chairman Zerby recessed the regular meeting and opened the Public Hearing for Proposed Ordinance #2-2004 to add Public/Private Schools as a conditional use in the Ag District.

 

At 7:03 P.M. Chairman Zerby closed the Public Hearing and reconvened the regular meeting.

 

Paul made a motion to approve Ordinance #2-2004, seconded by Bob C.  Motion carried unanimously and Ordinance was signed.

 

Subdivisions

·         John Sepp presented the No. 1 Cycle Center Storage Facility plan for signatures.  The facility was approved a long time ago, it has been built, inspected, and the Township Planning Commission signed the plan at their June 1 meeting.  He asked for signatures so he can get it recorded at the County.  Chairman and Secretary signed.

·         Stanley Wallace presented Thelma Brooks Component I Planning Module.  The Township Planning Commission signed it June 1st at their meeting.  Paul made a motion that Component I be signed, seconded by Monty, motion carried unanimously.  Chairman signed.

 

George Wool

·         George Wool attended representing Nittany Valley Machinery.  On April 10, 2004 he received two identical letters from Jeff McClellan, informing him to contact Jeff.  He called Jeff and was informed he needs a permit and in conjunction with the permit he needs a sewage permit and portable toilets.  He was also told he needs to get a driveway permit from Bellefonte (PennDOT), but the Clearfield office told him if he already has a driveway, he does not need a permit.  He spoke with the Commissioners and was told to get his permit, plow his fields and they would talk later.  He got his permit from Jeff.  If that was proper application of a permit, he requests exemption for his activities and if it is not proper application he would like his money back. 

·         Bob C. responded this is a zoning issue and Supervisors have nothing in it.

·         Tom asked George how much money the permit cost.  George said $100, and he was informed that every activity he does, would cost him another permit fee

·          Jeff said that is correct.  This is a special event with vendors, not just farming. 

·         Paul asked Bob R. if this needs to go before the Zoning Hearing Board.  Bob R. said it is not an issue for the Supervisors because it is a Zoning issue.  Paul told George if he does not agree with Jeff’s decision he needs to go before the Zoning Hearing Board.  The Supervisors cannot deal with Zoning issues. 

·         George asked what that procedure is and Jeff responded.

 

 

Zoning Officer’s Report

·         Presented May 2004 monthly report and July 2003-June 2004 annual report.

 

Secretary’s Report

·         Presented a letter from Dana Boob regarding Centre Hall Well #11 asking that comments be sent to DEP.  After review, they said they would like to have some information here at the Township; how can they comment when they have no information.  They would like to see DEP’s comments regarding the water quality.  Bob C. would like volume results and DEP results because he is concerned with the well drawing from our aquifers.

·         ELA Group requests Larry Campbell’s new private drive name be changed from 139 Upper Georges Valley Road to 121 Huckleberry Lane.  Brenda advised the Board Mr. Campbell brought in a Memorandum of Understanding June 1, 2004 for signature.  Tom made a motion to approve Huckleberry Lane, seconded by Bob C. motion carried unanimously.

·         Asked if SCCCTS should be removed from the Township web site.  Yes.

·         When I contacted the Fire Co. about the savings bonds the Board approved as prizes, I was told I was too late because the tickets were already printed.  Monty said it is not too late that he was told the bonds will be given away.

·         Asked if there will be a quorum for July 5 meeting which is a legal holiday.  Yes

 

Correspondence

·         CCPO comments on schools in Ag Zoning District.

·         DEP new Local Government Liaison Dave Vilello introducing himself.

·         PSATS workshops:  Implementing your Multi-Municipal Plan; Municipal Watershed Academy in College Township June 22 and 23, 2004; Food for Thought in State College June 9.

·         Penn Terra to Anson Burwell about No. 1 Cycle Center revised plan and Anson Burwell response to Penn Terra.

·         E-mail from Lachlan McIntosh who has two original Potters Mills account books from 1/2/1843 to 12/31/1849.  This person is trying to assess a fair value and sell these books and asked if Potter Township would be interested.  Board said to ask this person about historical value.

·         Received applications for the John Auman Leadership and the Bob Donaldson Planning Awards to be given out at the CCATO Fall Convention.

·         Note from CCATO regarding UCC Appeals Board.  The CCPO is considering this as a County Board of Appeals.  Comments and concerns can be addressed to Bob Jacobs.

·         Harry Roth’s draft Comprehensive Plan for Nittany Valley for a 45-day comment period.

·         “Growing Greener,” distributed.

·         County Comprehensive Plan Phase II, distributed.

·         Ashford Manor final plan from Anson Burwell asking for comments prior to the County’s June 15, 2004 meeting.  No comment.

 

In reviewing Jeff’s report, Tom asked Jeff about a special event permit and if this permit is for the monthly event that Company has.  Jeff said yes they get a permit each time they have a special event; price is $100 and permits are good for 21-days.  Tom also asked Jeff about a sign on a trailer on top of the Centre Hall Mountain.  Jeff said it is on a licensed vehicle.  Tom asked Jeff about a temporary fire works permit.  Jeff said this company sets up at Snappy’s every summer.

 

Road Superintendent’s Report

·         Presented price quote to paint the meeting room, secretary’s office and 2-bathrooms.  Tom made a motion to hire the painter per his quote, seconded by Rich, motion carried unanimously.  The total is $995 for labor and materials.

·         Tom asked Budd if we should hire a commercial cleaner to scrub and wax the floors.  Budd said probably after the painting is done.

 

Open Discussion

·         Bob C. asked the status of the new fire truck.  Monty said the chassis is ready, but the truck will not be here for the carnival.  Bob asked what the Fire Co. is doing for money.  He thinks instead of handing out money to the fire company, they should approach the Township if they need money and if they do not need money, then the Township needs to think about cutting back the fire tax.  Bob C. asked to go on record that this truck is much and long needed but after this truck is gotten we need to consider hard whether we can drop that fire tax and give the citizens less of a burden.  Paul agreed and said that is what the Township promised to begin with.  Bob C. said the Fire Co. needs to get away from getting a new fire truck every three years.  With the start of this new purchase they were up front with the Township and now they tell us nothing.  We should not continue collecting fire tax and not know what is going on.

·         Tom handed out Legislative Alert on Growing Greener II and discussed Parks and Recs.  He spoke with Lori with DCNR about the grant evaluation and proposed land.  She told Tom we can get $1,700 by just filling out the grant application.  We need to know if we have support from the other municipalities and the community.  Tom asked if we should apply for this grant and received an okay.  Tom said he and Brenda will work on the application.

·         Monty said the Planning Commission reviewed the proposed Ordinance #3-2004 for PCI district set back change and depending on how the building is placed on the lot, the proposed set backs will not work.  

·         Bob C. complimented Brenda and Budd on the outstanding Newsletter. 

·         Brenda publicly thanked Sandra Rishel and Carol Clitherow for their assistance with the Newsletter mailing.

·         Bob R. presented three copies of the American Legion Lease for the Park and Ride for signatures and asked Brenda for a copy of the Cooperative Agreement and the Resolution.

·         Bob R. asked Paul to call an executive session on litigation.

 

At 8:00 P.M. Chairman Zerby recessed the regular meeting for executive session on litigation.

 

At 8:25 P.M. Chairman Zerby reconvened the regular meeting and recessed the meeting and opened the worksession.

 

Adjourn

·         At 8:32 P.M. the regular meeting was reconvened and adjourned by Chairman Zerby.
