MEETING OF
The second monthly meeting of the Potter Township Board of
Supervisors was held on
Chairman Zerby called the meeting to order at
Minutes of the February 3, 2003 meeting and the Financial Report were approved, on a motion by Tom and seconded by Rich. Motion carried unanimously.
Citizens Concerns – none.
At
Chuck Herr, Jr. – Sewage Enforcement Officer (SEO)
· Chuck introduced himself and Pam Winter, the SEO alternate. He reported that due to the early winter and harsh weather conditions, they are months behind on land developments to start in the Spring.

He also reported that Department of
Environmental Protection (DEP) is making changes to the paperwork, especially Components
1 & 2. DEP is also making
considerable changes to the pattern he uses to do his testing which will
require some retesting and increase his costs.

Planning Commission – Report given by Sandra Rishel.
· Kathy Henry presented the Bonetti Subdivision. The Planning Commission put one signature on the Bonetti plan anticipating an approval letter from the Engineer.

Kathy Confer requests a zoning change from Agriculture
to light Commercial for 27 acres of land that she is purchasing that adjoins
her property. Rezoning for a home
occupation had been mentioned at last meeting, but it had not been understood
that Kathy intended to build a new building on this new land. Bob C. said the Planning Commission should
look at the whole entity from the Township line to the Commercial property
line. The Supervisors would like to see
the impact of commercial at that location since Route 322 traffic is already a
problem and Supervisors would like Kathy to look at combining roads instead of putting
a new road on to Route 322. Bob R. advised Kathy that #1 she needs to get
current land owner approval in writing to act on their behalf for this property,
#2 take the landowner approval letter with her own letter with her intent for
the property to Jeff McClellan and ask him what she needs to do to get her
intent to happen, #3 present all this to the Planning Commission who will make
recommendation to the Supervisors. Sandra R. told the Supervisors to give instructions
to the Planning Commission. The
Supervisors told Kathy that if she can obtain land owner approval by the March
3 meeting, she should come to the March 3 meeting and the Supervisors will give
direction to the Planning Commission.
· Fred Henry presented the Bonetti Subdivision. Fred thought the issues addressed by Innovative Consulting Group (ICG) were satisfied, but HRG has reopened some of those issues. The Supervisors agreed that Pond 2 is the only carry-over issue and they recommended that Fred and the new engineer meet and resolve the Pond 2 issue. In addition to the pond, the Township has two issues: #1 clearing the fence row and brush, and #2 removing the stone wall. Bob C. suggests they put up a bond to assure the work would be done before that lot is sold. Fred agrees to a bond or an escrow amount for the brush and the pond issue. The Supervisors agreed they need something to protect the Township and the land owners. Bob C. asked if Fred and Bob R. could work together on wording for a bond or escrow.
Old Business

Resolution 1-2003 that Potter Township supports
the formation of a task force to develop an Intergovernmental Cooperation
Agreement for Multi-Municipal Planning in Penns Valley. Paul made the motion to approve Resolution
1-2003, seconded by Tom, motion carried unanimously. Resolution was signed.
Solicitor’s Report
· He and Budd discussed road damage. They think the Township should establish weight limits. Penn Dot will do a study at no cost. Budd said Penn Dot is discontinuing this study program soon. Bob C. made a motion to proceed with the study, seconded by Paul, motion carried unanimously.
· He received a brief of Rallis Driveway case and has 20 days to respond.
· Emery Subdivision is extended again.

On the land studies grant, Bob Jacobs provided a
list of contractors. Bob C. made the
motion, seconded by Rich for Bob R. to proceed.
Motion carried unanimously.
Secretary’s Report
· Presented bills to be paid list for review and approval.
·
Presented Bank Resolution for approval and
signature to acquire a Safe Deposit Box. On a motion by Bob C., seconded by
Paul to approve opening a safe deposit box and to sign the bank resolution. The Secretary and Budd were directed to
inventory the file cabinet box together, then they should take these documents to
the bank and place in the safe deposit box together. After that, either the Secretary or the
Chairman can make transactions.
Correspondence

· HRG letter about Spring Creek Act 167 Ordinance that must be adopted by March 2003. Bob C. said he and Monty have been working on this. Bob R. recommends adopting Township-wide.
· E-mail received from Bob Jacobs for Bob R.
· Bob Jacobs comments on the proposed zoning ordinance.
Road Superintendent’s Report
· Posting and bonding roads which Bob R. already discussed.
· We need Newsletter input. PRINT will probably need the information within the month.
New Business
· Janell Bubb and members of the small community of 8 houses, calling themselves “Community Cleanup” came to the meeting because 3-families in their area have unbelievable junk. Janelle identified an area that they want cleaned up and said that last February they went to the Zoning Officer about these same people who started cleaning up then stopped. The junk is never all cleaned up and they want to know what to do about it. One of the families just rearranges their junk, they don’t remove it, they put it in a pit on the property. They asked who’s job it is to enforce junk issues? Bob R. replied it is a Code Enforcement issue not a Zoning issue. These people have been sited for junk previously by the Magistrate. Bob R. and Jeff walked the property together last February and took photos and the party started cleaning up. And, he pointed out a registered vehicle is not a junk vehicle. There are limits to what the Township can do to enforce the issue. The Supervisors said Bob R. and Jeff should make another site visit and if necessary take the situation to the magistrate.
